1 Who provides the service
This software-licence agreement is between you and PureSight Technologies Ltd. (“PureSight”, “we” or “us”), whose contact address is 23 Ha’atas Street, Kfar Saba 4442525, Israel. For PureSight licence and service assistance, contact support@puresight.com. The seller or supplier for your purchase or service subscription may be PureSight or a different entity identified in your order or activation confirmation.
The “Service” means the PureSight or Surfie applications, software, account dashboard, related documentation and online features, including a partner-branded consumer version, included in the plan described to you before activation. The plan description identifies the available features, supported operating systems, device limit, technical requirements, duration and any charges.
The Service may be sold directly by PureSight or through one or more levels of partners. A distributor may supply another partner that sells or supplies the Service to you. The identity of a party elsewhere in that chain does not, by itself, make that party your seller. Your order or activation confirmation identifies the entity contracting with you for the purchase or subscription and the relevant billing, support and cancellation contacts. This agreement governs use of the PureSight Service; it does not remove any party’s statutory responsibilities or rewrite your separate contract with the identified seller.
The information about your offer described in section 18 must be available before purchase or activation. It must not reduce mandatory rights or conceal a material qualification in a document you cannot access. The commercial sales chain does not determine who is a controller or processor of personal data; the applicable privacy notice explains those roles separately.
2 Acceptance and account eligibility
Read these terms before accepting them. We will make the applicable version available to save or download. Acceptance of this agreement is separate from any consent requested to process personal data.
The account holder must be an adult able to enter into this agreement. You may use child-protection features only as a parent or person with lawful parental responsibility or other legally valid authority. Do not use the Service to secretly monitor another adult, a partner, an employee or anyone else whom you are not legally entitled to monitor.
Keep your account details accurate and your credentials secure. Tell support promptly if you suspect unauthorised access. You are not automatically responsible for activity caused by our breach or for losses that applicable law does not place on you.
3 Licence and permitted use
For the agreed period, we grant you a non-exclusive licence to install and use the Service for personal or family use, or another use expressly authorised by your order or separate agreement, on the number of devices included in your plan. The licence is subject to this agreement and does not transfer ownership of our software.
You may make copies of documentation and any software backup that are reasonably necessary for permitted use or allowed by law. You may not sell, rent, sublicense or commercially redistribute the Service, bypass access controls, introduce malicious software, interfere with other users or use it unlawfully.
You may not reverse engineer, decompile or modify the software except where applicable law permits this, including mandatory rights relating to interoperability, error correction, observation, study or testing. Nothing in this agreement prohibits lawful criticism, consumer reviews, security research or exercise of rights that cannot lawfully be restricted.
4 Child protection and responsible use
Explain the relevant features to the child in language appropriate to their age and maturity. Respect the child’s privacy, developing autonomy and legal rights, as well as the rights of other people whose information may appear in communications.
Only enable features and permissions that are appropriate and lawful for the child and device concerned. A parent’s acceptance of these terms is not, by itself, a lawful basis for every processing operation. The Privacy Policy explains the relevant processing and available controls.
PureSight will provide the Service with reasonable skill and care, in accordance with the agreed functionality and applicable legal conformity requirements. The Service assists parental supervision. It does not guarantee detection, classification, blocking, prevention or reporting of every harmful item, interaction or event. Some risks may remain undetected, and alerts may be delayed, incomplete or incorrect. The Service does not replace appropriate parental supervision and is not an emergency response service. If someone is in immediate danger, contact the appropriate emergency service.
These limitations describe the nature of the Service. They do not exclude our responsibility to supply the features and quality promised, or your statutory remedies.
5 Features and technical requirements
Functionality can differ by product, device, operating-system version, network connection, permissions and third-party platform restrictions. The plan description and compatibility information provided before purchase or activation form part of the agreed Service.
PureSight supports the two latest versions of supported operating systems and the two latest versions of its applications or system software. We will identify the relevant supported versions in the applicable compatibility information. Release of a new version does not, by itself, authorise an immediate cutoff of the Service or reduce our agreed supply, security-update or statutory conformity obligations.
You are responsible for obtaining a compatible device and connection where this has been disclosed in advance. We will explain permissions needed for a feature and the consequences of not enabling them. A change in a third-party platform does not automatically remove any remedy you have for a lack of conformity.
6 Price duration and renewal
Before you enter a paid subscription, the seller must provide the total price including applicable taxes, billing frequency, initial term, any minimum commitment, renewal conditions and a clear cancellation method. Any trial must state its duration, what happens when it ends, and whether an expressly agreed paid subscription follows.
This agreement does not itself authorise a charge or automatic renewal. Charges and renewal apply only as clearly disclosed and agreed in your order. We will not add an optional paid service without your consent.
You can end renewal using the method stated in the order or account interface, or contact the identified seller for help. Ending renewal normally leaves access available until the paid period ends, unless your order provides a more favourable outcome or law requires otherwise. Statutory withdrawal, refund and termination rights remain separate.
7 Updates and changes to the Service
We will provide updates, including security updates, required to keep the Service in conformity for the period required by applicable law and the agreed supply period. The pre-contract information will state any minimum software-update period that we have supplied to the seller, expressed as a duration or end date. We will explain when an update is available and any consequences of not installing it. If you do not install an update within a reasonable time, any limitation of our responsibility applies only where the law’s conditions are met.
Beyond changes necessary to maintain conformity, we may modify the Service only for a valid reason stated here: adapting to changes in law or technology, maintaining security, responding to changes in supported platforms, or improving functionality. Such a change must not impose an additional charge.
We will explain changes clearly. For a consumer in the European Economic Area (EEA), if a modification negatively affects access to or use of the Service more than only to a minor extent, we will give reasonable advance notice on a durable medium describing the change, timing and applicable right to terminate free of charge. You may exercise that right within 30 days of receiving the information or of the modification, whichever is later, unless we enable you to retain the unchanged, conforming Service at no additional cost. Other mandatory rights are unaffected. Changes made in accordance with this section do not require renewed acceptance of this agreement unless applicable law requires it.
8 Statutory quality and remedies
We must supply the Service in accordance with the contract and applicable law, including applicable requirements for functionality, compatibility, accessibility, continuity and security.
If the Service is not supplied or is not in conformity, you may be entitled to have it supplied or brought into conformity free of charge, within a reasonable time and without significant inconvenience. Where the legal conditions are met, you may instead be entitled to a proportionate price reduction or termination and reimbursement.
A commercial warranty, support arrangement or free trial does not replace or reduce your statutory rights. In particular, these terms do not impose a universal 12-month limit or make maintenance your exclusive remedy. Applicable digital-content and digital-service rights may also protect an arrangement where personal data, rather than money, are provided, where the statutory conditions apply.
Contact support@puresight.com about a fault. Where the seller is a partner, you may also contact the seller. We will not use the distribution arrangement to exclude a responsibility that the law places on us.
9 Withdrawal and cancellation
Where you have a statutory right to withdraw from a distance contract, the seller must provide the applicable instructions and model form before you are bound. For consumers in the EEA, the normal withdrawal period for a service or digital-content contract is 14 days from conclusion, subject to the applicable rules and exceptions, including any extended period resulting from failure to provide required information.
Starting supply does not automatically remove that right. A loss of the right for digital content not supplied on a tangible medium requires the legally prescribed prior express consent, acknowledgment and contract confirmation. For services, different rules apply, including the conditions for full performance and any proportionate payment after an express request to begin performance during the withdrawal period.
To withdraw, send an unequivocal statement identifying your contract to the seller identified in your order or contract confirmation, using the withdrawal contact details it provided, or use its online withdrawal function where available. You may use the withdrawal notice at the end of this agreement or the form supplied by your seller, but neither is compulsory. Sending the notice before the withdrawal period expires is sufficient. Where withdrawal is valid, the seller reimburses payments due under the applicable rules without undue delay and no later than 14 days after being informed, normally using the same payment method and without a fee. A proportionate charge for services already supplied is payable only where the applicable legal conditions, including your express early-start request and the required information, are satisfied.
No general acceptance of this agreement is a withdrawal waiver. The seller must explain which withdrawal rules apply and obtain any required separate express request or acknowledgment during the order process. For contracts concluded through an online interface where required by law, the seller must also provide an easily accessible online withdrawal function throughout the withdrawal period, explain its location before the contract, obtain an unequivocal confirmation and promptly send a durable receipt with the statement and its date and time. Additional local consumer protections apply as described in section 17.
10 Suspension and termination
We may restrict access only where reasonably necessary to address a material breach, an immediate security risk, unlawful use or a legal requirement. Where reasonably possible, we will explain the grounds and give you a reasonable opportunity to remedy a breach before suspension or termination.
We may act immediately where notice would create a material security risk, enable unlawful conduct or conflict with law. Any restriction must be proportionate. We will provide a way to contest an erroneous restriction and restore access when the grounds no longer apply.
Termination does not affect rights or payments already due, nor any statutory right to reimbursement. Where we stop providing a paid Service without grounds attributable to you, we will reimburse the unused prepaid period, without limiting other legal remedies.
When access ends, stop using the licensed software. Information about data access, export and deletion is in the Privacy Policy and applicable law. We will honour applicable rights to retrieve content after termination and will not require destruction of records you are legally entitled to keep.
11 Intellectual property and third party components
PureSight and its licensors retain their intellectual property rights in the Service. You retain any rights you hold in your own content and personal information.
Third-party and open-source components may have their own applicable licence notices. Those notices govern the relevant components where required, and this agreement does not restrict rights granted by a mandatory or applicable open-source licence.
12 Privacy
The Privacy Policy explains how personal data are processed. It is an information notice, not a waiver of privacy rights and not a substitute for a valid legal basis or any consent required by law.
You and the child may have distinct data-protection rights. Requests are assessed with appropriate attention to identity, parental authority, the child’s interests and applicable law. Personal data are not transferred to us as intellectual property under this agreement.
13 Liability
Each party is responsible for loss for which it is liable under applicable law. PureSight is not responsible for loss that is not legally attributable to it. Nothing in this section transfers our statutory responsibilities to you or a distribution partner.
For claims to which the cap applies, PureSight’s total liability arising from the same event or series of related events will not exceed the total licence and subscription fees you actually paid for the affected Service during the 12 months immediately before the event giving rise to the claim, whether you paid PureSight directly or an authorised seller. If you paid no such fees during that period, the cap is US$1.
We do not exclude or limit liability for fraud, intentional misconduct or gross negligence; death or personal injury where exclusion or limitation is prohibited by law; compensation required by data-protection law; or any other liability that cannot lawfully be excluded or limited. The cap does not restrict statutory rights to conformity, repair or correction, replacement, price reduction, termination or refund. It does not restrict a child’s or any other third party’s independent rights.
If the mandatory law applicable to you prohibits this cap, requires a higher cap or provides a remedy or compensation that cannot be limited in this way, that law prevails and this cap will not restrict those rights.
The Service does not provide 100% detection or protection. Even when functioning in accordance with the agreed functionality, it may fail to detect a risk or prevent a harmful event. You acknowledge these inherent limitations. The Service assists parental supervision and does not replace it.
14 Changes to these terms
Changes to the Service are governed by section 7; this section concerns changes to the legal terms. We may propose changes for the reasons described in section 7. A new commercial offering, price or paid commitment binds you only through a valid agreement; it does not authorise a unilateral change to an already agreed fixed-term price. We will notify you in advance in a clear, accessible form and identify the effective date and material changes.
Changes do not retrospectively remove accrued rights. Where your agreement is required, a website posting or silence alone is not acceptance. If a change materially disadvantages you and applicable law gives a termination right, we will explain and honour that right. A change requiring a new paid commitment requires your express agreement.
15 Contact and complaints
For service assistance or complaints, contact support@puresight.com. For billing or cancellation, use the seller’s contact information in your order; you may also ask us to help identify the correct contact.
We will identify any applicable alternative dispute resolution body and whether we are obliged or willing to participate when required by law. This agreement does not require arbitration or restrict your right to use a competent court.
16 Applicable law and general provisions
For consumers outside the EEA, Israeli law applies only to the extent this does not deprive you of mandatory protections under the law that otherwise applies to your consumer contract. This choice does not impose exclusive jurisdiction in Israel or prevent you from using courts available to you under mandatory law.
If a term is invalid, it will not bind you to the extent of that invalidity; the remaining agreement continues where legally possible. An unfair consumer term is not rewritten merely to preserve an advantage for us. A delay in enforcing a right does not waive it.
We may transfer this agreement only if this does not reduce your contractual guarantees or statutory rights. You will receive notice where required. Nothing here excludes enforceable pre-contractual information or representations.
17 Mandatory consumer protections
Nothing in this agreement excludes mandatory consumer rights that apply to you. The provisions below apply where the relevant consumer and jurisdiction conditions are met; they do not limit mandatory protections available elsewhere.
For a consumer habitually resident in the European Economic Area (EEA), this agreement is governed by the law of the country of habitual residence. You retain the right to bring proceedings in the courts available under applicable consumer-jurisdiction rules. We may bring proceedings against you only in the courts permitted by those rules. Wherever you live, this agreement does not deprive you of any mandatory protection concerning applicable law or access to a competent court.
You retain the rights and remedies provided by applicable mandatory consumer law, including rights relating to supply, conformity, withdrawal, refunds and unfair terms. The responsible trader must supply the agreed digital content or service and remedy a lack of conformity on the conditions prescribed by that law.
Where mandatory EEA digital-content or digital-service rules apply, the responsible trader is responsible for conformity throughout an agreed period of continuous supply; one-off supply is subject to the applicable statutory time rules. Where a statutory refund is due following price reduction or termination under those rules, it must be made without undue delay and in any event within 14 days of the relevant notice, by the legally required payment method and without imposing a fee. Any more protective mandatory local rights remain unaffected.
Where applicable law requires contractual information, terms or confirmations in a particular language, or gives a language version priority, we will provide and honour those requirements. No language version may be used to reduce your mandatory rights. Any uncertainty, inconsistency or translation discrepancy is interpreted in the manner most favourable to the consumer where required by mandatory law.
The protections that apply to you under this section prevail over any conflicting term elsewhere in this agreement, an activation screen or a general product notice. The seller must provide any pre-contractual information, withdrawal instructions and durable-medium confirmation required by applicable law in the required language.
18 Your order and plan
Your order or activation confirmation and plan description set out the Service you receive, the legal identity and contact details of the seller or supplier contracting with you, any charges and the applicable subscription or access period. They also identify the relevant support, billing, complaints and cancellation arrangements and any local terms that apply to your offer.
Information about available features, device and other usage limits, compatibility, required permissions, the supply period and software updates must be provided before purchase or activation. Where access is included in another product or paid for by another party, the information supplied with the offer explains the included access and the conditions for continuing after that access ends.
For statutory withdrawal and refunds, use the seller and contact information supplied with your order or contract confirmation. For a partner purchase, send your notice to that seller or the recipient it has authorised. PureSight support can help identify the relevant contact, but support assistance does not replace sending the notice to the proper recipient.
Your order, plan description and these terms must be consistent. Mandatory law prevails; offer-specific terms cannot remove the consumer protections in section 17 or other mandatory rights. Any permitted additional non-consumer use must be expressly defined. These documents do not amend separately negotiated contracts between other parties in the distribution chain or establish data-protection roles.
Withdrawal notice
Use the following notice only if you wish to withdraw from the contract and a right of withdrawal applies. You may instead use the form supplied by your seller or any other unequivocal statement of withdrawal.
Send the notice to the seller identified in your order or contract confirmation, using the withdrawal contact details it provided.
I hereby give notice that I withdraw from my contract for the provision of the following service or digital content: ____________________.
Ordered on: ____________________. Consumer name: ____________________.
Consumer address: ____________________. Date: ____________________.
Signature of consumer only if this form is sent on paper: ____________________.
This notice does not replace an online withdrawal function or the withdrawal information and model form that the seller must provide where required by law.
